The European Court of Justice has ruled that refugees seeking asylum due to their sexuality need not undergo tests to prove that they are homosexual. This ruling applies to all EU member states, following the Dutch refusal of asylum to three men, on the grounds that they “had not proven their sexuality”. States including the UK and the Czech Republic have also been criticized for their handling of gay asylum seekers.
